Your Right to Repair Your Own Credit for Free
Under the Credit Repair Organizations Act (CROA), 15 U.S.C. sections 1679-1679j, and the Fair Credit Reporting Act (FCRA), 15 U.S.C. section 1681, you have the legal right to dispute inaccurate, incomplete, or unverifiable information on your credit reports directly with the three major credit bureaus (Equifax, Experian, and TransUnion) at no cost to you.
You do NOT need to hire a credit repair company to exercise this right. The credit bureaus are required by law to investigate your disputes (typically within 30 days) and remove or correct information they cannot verify.
What Credit Repair Companies Cannot Do
- Cannot guarantee specific results or outcomes. No credit repair company can guarantee a specific credit score increase. Any company that guarantees a specific number of points of improvement or a specific credit score is making a claim that may violate the CROA.
- Cannot remove accurate, timely negative information from your credit report. If negative information on your credit report is accurate and has not yet aged off (typically 7 years, or 10 years for certain bankruptcies), no one can legally remove it.
- Cannot charge you before services are fully performed. Under the CROA and many state laws, credit repair companies are prohibited from collecting payment before the promised services have been fully performed. If a company asks for a large upfront fee before doing any work, this may be a violation of federal and/or state law.
- Cannot ask you to waive your rights. Under the CROA, credit repair companies cannot ask you to waive any of your rights as a consumer, including your right to sue the company or your right to a written contract.
Your Right to Cancel
Under the Credit Repair Organizations Act, you have the right to cancel any contract with a credit repair company within three (3) business days of signing it, for any reason, without penalty. The company must provide you with a written notice of this right before you sign a contract.
